If you are located in a geographic jurisdiction that has banned the use of such platforms, cryptocurrency, or blockchain-based services, the onus is on you to not participate. The company has control over the drawing process for the determination of winners in giveaways and contests. All draws are conducted fairly and transparently. The result of our drawing system will be deemed correct and final at the company's discretion.

The Company owns all the rights to the Platform. By entering into an agreement with us through the use of the Terms we provide you with access to use the Platform. A breach of the Terms will result in this agreement between us being broken and your account will be terminated, suspended, or limited.

Using the site and agreeing to the Terms grants us permission to use any feedback, content or non-personal information that you provide about the site.

Winners will also be required to have their username posted publicly after winning and the Platform reserves the right to interview, in a capacity deemed appropriate at the time, the winner to use for further marketing material. We reserve the right to suspend or terminate your account with the Platform at any time if we believe you have violated the Terms.

We are not responsible for any losses that you may incur due to any alterations to the site nor are we responsible for any losses that you may incur due to any breaches of these Terms. Any winnings that we deem are won illegitimately will be withheld. We reserve the right to choose as to what happens to these winnings.

It is the user's sole responsibility to declare their winnings to any relevant authority bodies, for taxation purposes or otherwise. We bear no liability for the user's actions after winnings have been transferred outside of our account.

To access the Platform you must:

• Provide us with the required details upon the creation of an account.
• Only have one registered account with us at any time.
• Be 18 years of age or older. Anyone found to have accessed the site younger than the age of 18 will have their account immediately terminated and any winnings will be withheld.
• Not be playing within a restricted jurisdiction, as previously defined. This includes any manipulation of your jurisdiction (VPN usage).

• Attack the site through any technological means including but not limited to viruses, trojan horses and DDOS.
• Interfere or attempt to interfere with the drawing system, or cast doubt over the drawing system's accuracy.
• Provide false details about you, or your use of the site.
• Farm information or details from the Platform or associated entities.
• Act in a way that is abusive, as judged by the Company, in any capacity towards anyone for any reason.
• Access the site from a restricted jurisdiction or access the site on someone else's behalf, who resides in a restricted jurisdiction.

Should we determine that you have breached any of the Terms outlined in this document we reserve the right to terminate, suspend, limit your access to the site and withhold any winnings that we deem to have been earned illegitimately. Should any major damage to the company occur, relevant law enforcement will be cooperated with to rectify any issues and consequences coming from your breach in the Terms.

If we believe that any Terms have been breached, we may seek to receive further information from you. Should you fail to comply with our requests, or insufficiently comply, we may terminate, suspend or limit your access to the site and withhold any winnings that we deem to have been earned illegitimately.

• Cryptocurrency and blockchain technologies involve inherent risks including but not limited to market volatility, technical failures, and regulatory changes.
• $LUCK tokens may fluctuate in value and you may lose some or all of your investment.
• Blockchain transactions are irreversible and we cannot recover tokens sent to incorrect addresses.
• Network fees, gas costs, and transaction times are determined by the blockchain network and are outside our control.
• You are responsible for understanding the tax implications of cryptocurrency transactions in your jurisdiction.
• The $LUCK token is subject to the terms and conditions outlined in our whitepaper and may be updated from time to time.

You agree to defend, indemnify, and hold harmless us and our licensors, and each of their respective employees, officers, directors, and representatives (collectively, the “Company Parties”) from and against all liability for damages, claims, or losses—including legal fees—arising from: (i) your use of our Platform or Features, (ii) violations of our Terms or laws by you or your users, (iii) disputes with third parties, (iv) intellectual property infringement, or (v) your Feedback.

If we face a related legal claim, you will cover our response costs, including employee time and attorney fees. We retain full control over handling or settling such claims, and you agree to cooperate with the defense or settlement.

To the extent permitted by law, we are not liable for any indirect, incidental, or consequential losses, including lost profits, revenue, goodwill, data, or business opportunities, even if advised of potential damages. We are not responsible for:

• Your inability to access or use the Site or Features due to downtime, termination, or suspension;
• Costs of obtaining alternative goods or services;
• Loss, corruption, or unauthorized access to your data;
• Any change in cryptocurrency values; or
• Damages from hacking, tampering, or security breaches.

Before taking legal action, both parties agree to first attempt to resolve disputes through good-faith negotiations. The complaining party must provide written notice outlining the issue (“Initial Notice”), and the other party has 20 days to respond. If the dispute is not resolved within 90 days, either party may opt for mediation or arbitration.

Any dispute related to these Terms or Features will be settled by binding arbitration. Arbitration decisions are final, except that claims for public injunctive relief must be handled in a civil court.

Class Action Waiver: All arbitration must be conducted on an individual basis. Class arbitrations, class actions, and multi-party claims are not permitted. You agree that disputes cannot be consolidated with other cases, and the arbitrator has no authority to preside over any form of class action.

By agreeing to these Terms, both parties waive the right to a jury trial or participation in any class or representative action.

Entire Agreement: These Terms represent the complete and exclusive agreement between you and Lucky Cat Club regarding the subject matter addressed herein. They override any prior or simultaneous discussions, understandings, agreements, or communications—whether written or oral—between you and Lucky Cat Club related to this subject matter.

No Relationship or Assignment: Nothing in these Terms establishes any relationship between you and Lucky Cat Club beyond what is explicitly defined. Neither party is an agent, partner, or representative of the other. You may not present yourself as having any relationship with Lucky Cat Club other than as a user of our platform, features, or interface.

You are not allowed to assign or transfer any of your rights or obligations under these Terms without prior written consent. Lucky Cat Club may freely assign or transfer these Terms, in whole or in part, without restriction. Any unauthorized assignment or transfer by you will be considered void. Subject to these limitations, these Terms will be binding upon and benefit both parties and their permitted successors or assigns.

Waiver: If Lucky Cat Club chooses not to enforce any provision of these Terms at any given time, that decision does not waive our right to enforce that provision in the future. Any waiver must be provided in writing and signed by an authorized representative of Lucky Cat Club to be effective.

Severability: If any part of these Terms is found to be invalid or unenforceable, the remaining sections will still apply in full force. The invalid portion will be interpreted to best reflect the original intent, and if that's not possible, it will be removed without affecting the rest of the Terms.

Remedies: Any rights or remedies available to Lucky Cat Club under these Terms are in addition to any rights or remedies available under applicable law or equity. A delay or failure by Lucky Cat Club to enforce any provision shall not be considered a waiver of that provision or of any other rights.
